You further agree that this User Agreement forms a legally binding contract between you and Seducenow.com, and that this Agreement constitutes "a writing signed by You" under any applicable law or regulation. Any rights not expressly granted herein are reserved by Seducenow.com. This Agreement is subject to change by us without prior notice (unless prior notice is required by law), by posting of the revised Agreement on the Seducenow.com website. It is your duty to check for the current version of this agreement. Last modification date will always be posted at the bottom of this agreement. You may review the current Agreement prior to initiating a transaction at any time at our User Agreement page. This Agreement was last modified on Sept. 01, 2002.

Seducenow.com has adopted a set of information management guidelines which serve as the basis for our customer and advertiser relationships. These guidelines have been developed with the recognition that Internet technologies are rapidly evolving, and that underlying business models are still not established. Accordingly, guidelines are subject to change. Any such changes will be posted on this page. If the changes represent a material departure from our current practices with respect to the use of personal information, the changes will be posted on this page thirty days prior to taking effect and registered users will be notified via email.

IP Addresses: Seducenow.com also logs IP addresses, or the location of your computer on the Internet, for systems administration and troubleshooting purposes. We do not use IP address logs to track your session or your behavior on our site.

Subscription: Your subscription to seducenow.com can be cancelled by us or you, however no refunds, or part there of, will be given for period of cancellation. For example if you cancelled on the 15th of May and your subscription renews on the 1st of August you will not receive any credit for the period leading up to August 1st. If you signup using paypal, you can cancel your account by logging in to your paypal account.

YesMail: During the registration process, new users who select to register for YesMail become YesMail members. If you select this option, YesMail will use the information collected on the YesMail/Seducenow.com registration form to provide targeted e-mails to you on behalf of advertisers. You will only receive e-mail messages from YesMail if you elect this opt-in service. Seducenow.com on may use this information to contact you on rare ocasions, such as when our site is upgraded or for any promotions we offer.

Compliance with Legal ProcessWe may disclose personal information if we are required to do so by law or we in good faith believe that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend our rights and property; (3) protect against misuse or unauthorized use of Seducenow.com or (4) protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).

ARISING FROM ANY CLAIM RELATING TO THIS AGREEMENT OR THE SUBJECT MATTER HEREOF SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF SEDUCENOW.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON SEDUCENOW.COM SERVICES, FROM INABILITY TO USE THE SEDUCENOW.COM SERVICES, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF SEDUCENOW.COM SERVICES (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). THIS LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON SEDUCENOW.COM OR RECEIVED THROUGH ANY LINKS PROVIDED, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON SEDUCENOW.COM OR RECEIVED THROUGH ANY LINKS PROVIDED ON SEDUCENOW.COM. THIS LIMITATION SHALL ALSO APPLY, WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA. SUCH LIMITATION SHALL FURTHER APPLY WITH RESPECT TO THE PERFORMANCE OR NON-PERFORMANCE OF SEDUCENOW.COM SERVICES OR ANY INFORMATION OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR RELATED IN ANY WAY TO, SEDUCENOW.COM SERVICES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING AN FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.

SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Without limiting the foregoing, under no circumstances shall SEDUCENOW.COM be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.
